1) Who may use the Services

You must be at least 18 years old and capable of forming a binding contract to use the Services. If you use the Services on behalf of an organization, you represent that you have authority to bind that organization, and “you” includes the organization.


2) The Services are not emergency services

The Services may provide monitoring, alerts, recommendations, and reports related to wildfire risk and mitigation. ZionDome is not an emergency response provider and does not dispatch firefighters or emergency personnel. Always follow official guidance and contact local emergency services in urgent situations.


3) No insurance, legal, or professional advice

The Services may include risk indicators, scenario outputs, and documentation tools. They are provided for informational and operational planning purposes only and do not constitute insurance, legal, engineering, or professional advice.

ZionDome is not an insurer, broker, or agent, and does not issue insurance policies. Any insurance-related outcomes (including premium impacts) depend on third parties and their underwriting decisions.


4) Accounts and security

You may need an account to use parts of the Services. You are responsible for:

  • providing accurate information,
  • maintaining confidentiality of login credentials,
  • all activity under your account.

Notify us promptly of unauthorized access or suspected compromise.


5) Acceptable use

You agree not to:

  • misuse the Services, interfere with operations, or attempt unauthorized access,
  • reverse engineer or scrape the Services except as permitted by law,
  • upload malware or harmful code,
  • use the Services to violate laws, third-party rights, or privacy obligations,
  • use the Services to create or support unlawful surveillance.

We may suspend or terminate access for violations.


6) Data sources, accuracy, and limitations

The Services may use third-party data sources (e.g., satellite imagery, weather feeds, maps, sensors) and user-provided data. You understand that:

  • outputs may be delayed, incomplete, or inaccurate,
  • conditions can change quickly in wildfire contexts,
  • AI-based outputs include uncertainty and may contain errors.

You are responsible for verifying decisions appropriate to your situation, including when required for safety, legal compliance, or underwriting.


7) Hardware and on-site systems (if applicable)

If you deploy hardware or on-site protection systems in connection with the Services (“Hardware”):

  • you are responsible for proper installation, maintenance, and safe operation,
  • you must follow provided instructions and applicable regulations,
  • performance may depend on environmental conditions, utilities, and connectivity.

Hardware may be provided by ZionDome or third parties. Separate terms (purchase, rental, warranties, installation responsibilities) may apply and will govern Hardware to the extent they conflict with these Terms.


8) Municipal workflows and enforcement

If you use municipal workflows (e.g., case drafting from imagery):

  • ZionDome may generate draft cases and supporting evidence artifacts,
  • human verification is expected before enforcement actions,
  • you are responsible for due process, policy compliance, and lawful use.

ZionDome does not make legal determinations on your behalf.


9) Intellectual property

The Services, including software, models, designs, text, and graphics, are owned by ZionDome or its licensors and protected by intellectual property laws.

Subject to these Terms, ZionDome grants you a limited, non-exclusive, non-transferable, revocable license to use the Services for your internal business or personal use as applicable.

You may not copy, modify, distribute, sell, lease, or create derivative works of the Services except as expressly permitted.


10) Your content and feedback

You may submit data, documents, images, inspection logs, or other content (“User Content”) to the Services. You retain ownership of your User Content.

You grant ZionDome a worldwide, non-exclusive license to host, process, transmit, and display User Content only as needed to provide and improve the Services, comply with law, and enforce these Terms.

If you provide feedback or suggestions, you grant ZionDome the right to use them without restriction or compensation.


11) Privacy

12) Payments, subscriptions, and taxes (if applicable)

If you purchase paid Services:

  • fees, billing frequency, and plan terms will be shown at checkout or in an order form,
  • you authorize us (and our payment processors) to charge your payment method,

Unless required by law or stated in writing, fees are non-refundable.


13) Service availability and changes

We may modify, suspend, or discontinue parts of the Services, and we may update these Terms from time to time. If changes are material, we will provide reasonable notice (e.g., by posting on the website or emailing account administrators). Continued use after changes means you accept the updated Terms.


14) Termination

You may stop using the Services at any time. We may suspend or terminate your access if:

  • you breach these Terms,
  • we must do so to comply with law,
  • continued provision would create security or operational risk.

On termination, your license ends. Sections intended to survive termination (e.g., IP, disclaimers, limitation of liability) will survive.


15) Disclaimers

THE SERVICES ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE MAXIMUM EXTENT PERMITTED BY LAW, ZIONDOME DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT.

ZIONDOME DOES NOT WARRANT THAT THE SERVICES WILL BE ERROR-FREE, UNINTERRUPTED, OR THAT ANY OUTPUTS WILL BE ACCURATE OR COMPLETE.


16) Limitation of liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW:

  • ZIONDOME WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES (INCLUDING LOST PROFITS, LOST REVENUE, LOSS OF DATA, OR BUSINESS INTERRUPTION).
  • ZIONDOME’S TOTAL LIABILITY FOR ALL CLAIMS RELATING TO THE SERVICES WILL NOT EXCEED THE AMOUNT YOU PAID TO ZIONDOME FOR THE SERVICES IN THE 12 MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM (OR USD $100 IF YOU HAVE NOT PAID ANY FEES).

Some jurisdictions do not allow certain limitations, so these limits may not fully apply to you.


17) Indemnification

You agree to indemnify and hold harmless ZionDome and its directors, officers, employees, and contractors from claims, damages, liabilities, and expenses (including reasonable legal fees) arising out of:

  • your use of the Services,
  • your User Content,
  • your violation of these Terms or applicable law,
  • your deployment or operation of Hardware (if any).

18) Governing law and dispute resolution

These Terms are governed by the laws of Delaware, without regard to conflict of law principles.

Any dispute arising from these Terms or the Services will be brought in the state or federal courts located in Delaware, and you consent to jurisdiction and venue there.

If you are a consumer, you may have mandatory rights under your local laws that cannot be waived by these Terms.


19) Miscellaneous

  • Assignment: You may not assign these Terms without our consent. We may assign them as part of a merger, acquisition, or asset sale.
  • Severability: If any provision is unenforceable, the remainder remains in effect.
  • No waiver: Failure to enforce a provision is not a waiver.
  • Entire agreement: These Terms and any referenced policies/order forms are the entire agreement regarding the Services.
